The landmark measure passed, 5-4, with Republican appointed Justice Anthony Kennedy voting in favor of same-sex rights while all other GOP appointees dissented, politico.com reported.

New York's first openly gay congressman, Sean Patrick Maloney, whose district includes parts of Westchester and Putnam, is himself in a same-sex marriage.

“The Supreme Court made the right decision today by recognizing same-sex marriages and treating all same-sex couples across the country equally under the law" Maloney said in a statement. "Today the court continued the progress of the civil rights movement, and reaffirmed a moral truth about freedom in America that is, as John Kennedy said, 'as old as scripture and as clear as the American Constitution.' "

Same-sex marriage has legal in New York since July 24, 2011 when Gov. Andrew Cuomo signed the Marriage Equality Act just hours after the measure passed in the New York State Legislature.

President Barack Obama took to Twitter to proved commentary on the landmark decision.

"Today is a Big Step in our march toward equality. Gay and lesbian couples now have the right to marry, just like anyone else. #LoveWins," Obama tweeted

All four justices who were opposed to the decision wrote statements of dissent, politico.com said.
