After being arrested by federal officials on Tuesday morning, John Earvin, 67, was charged with a felony count of wire fraud, which carries a maximum 20-year sentence. He was arraigned in Manhattan later that day.
As recently as 2011, Earvin was a republican nominee for the New Rochelle City Council, though he was defeated by Jared Rice, who remains a member of the government out of District 3.
According to a statement from Preet Bharara, U.S. attorney for the Southern District of New York, Earvin, a former Metropolitan Transportation Union president, stole more than $48,000 while he was managing union finances from February 2007 to April 2010.
“Through his presidency, Earvin allegedly perpetrated a scheme to defraud the union by diverting union dues payments deposited into the account for his own benefits, principally by making hundreds of ATM withdrawals at off-track betting facilities and other locations and making personal use of the funds,” he stated
“In furtherance of the scheme and to prevent its discovery, Earvin, as alleged, repeatedly lied to union members about the account, claiming he could not provide an accounting of funds to union members because an independent auditor was reviewing the union’s finances.”
