According to a News12 report, Eastchester Police Chief Timothy Bonci, who’s been investigating the deaths of Eastchester millionaire Archie Harris and his aide, Betty Ramcharan at their mansion in 1996, has stated that they still believe they arrested the man who committed the crime, even after he was found not guilty in his fifth trial this week.
Previous trials of Days, a Mount Vernon native, ended with mistrials, including a conviction that was later overturned. He spent more than 15 years in prison while the trials played out. On Tuesday, he was found not guilty by a jury in his fifth trial, likely ending any future deliberations.
Westchester County District Attorney Anthony Scarpino, Jr. said In a statement, “Though we are disappointed in (the) verdict, we respect the decision of the jury in this case.”
According to the report, Bonci believes that some Westchester residents are questioning whether Days got away with murder following the not guilty verdict.
Days was arrested in 2001 for the double murder, and subsequently sentenced to a pair of 25-years-to-life prison terms. The first hung jury came in 2003, and he was sentenced to 50-years in prison the following year when the conviction was upheld by an appellate court.
On Sept. 2, 2015, the guilty verdict from his fourth trial was thrown out by a state appeals court, which led to the upcoming fifth trial. The conviction was dropped after Days appealed that he wasn’t allowed to introduce certain expert testimony in his 2011 trial.
