Fairfield Police Charge Man With Using Brother's Driver's License

FAIRFIELD, Conn. -- Two Bridgeport brothers were arrested early Friday after an incident that began with an illegally parked car near a hookah lounge, continued with criminal impersonation and ended with the discovery of marijuana in the car, Fairfield police said.

Joey Philson, 22, of Marion Street, Bridgeport, was illegally parked on the side of the road near Sky Hookah Lounge on Kings Highway East, with his turn signal on and another car parked next to his vehicle blocking his signaled turn, police said.

As an officer approaching the parked vehicles that had a crowd of people surrounding them, Philson performed a U-turn and headed down Kings Highway East, forcing the officer to return to his cruiser and stop the vehicle, police said.

When the officer approached the vehicle, a strong smell of “fresh marijuana” was emanating from the vehicle, according to police. When asked for his driver's license, Philson handed over a Connecticut adult learner’s permit, police said.

Officers identified the acting instructor, a female passenger in the rear middle seat, before running the identification and discovering the permit’s owner, Kyle Philson, had a warrant out for his arrest in Waterbury, police said.

The driver, who was actually Joey Philson, was asked to step out of the vehicle and placed under arrest for the warrant confirmed out of Waterbury, police said. During a search, officers discovered marijuana in Joey Philson’s possession, police said.

During the investigation, officers determined that Joey Philson had handed officers his brother’s learner’s permit, police said. Both the picture and date of birth did not match that on the identification, police said.

Officers determined that Kyle Philson was a passenger in the vehicle and was asked to step out of the vehicle, according to police. When he got out of the car, officers found two wallets in Kyle Philson’s back pockets, police said.

Officers searched the wallets found an identification card for Joey Philson that matched the driver of the vehicle, police said. A further search of the vehicle found more marijuana on the floor of the passenger seat that Joey Philson said was his, police said.

Both men were placed under arrest and taken to Fairfield Police Headquarters, police said. 

Joey Philson was issued an infraction on possession of marijuana of less than one ounce and improper parking. He is due in court on Feb. 13 in the infractions.

Joey Philson was also issued misdemeanor summons and charged with driving without a license, criminal impersonation and interfering with an officer. He was released on a promise to appear in court on Jan. 30 on his summonses.

Kyle Philson was processed for his arrest warrant out of Waterbury.
