NEW YORK, N.Y. Eastchester Schools Superintendent Marilyn C. Terranova, president of the New York State Council of School Superintendents (NYSCOSS), joined New York City Mayor Michael Bloomberg at his news conference last week announcing proposed legislation to better protect students from sexual misconduct. The announcement was made at Gracie Mansion in New York City.
The proposed reform would allow school districts and in New York City, the schools chancellor to have the final say on both the case and disciplinary actions taken. Hearing officers would submit their decisions to the school district for review, but the district would make the final decision.
The change would need the approval of the state Legislature.
This approach more similarly mirrors the due process and disciplinary proceedings taken with other tenured employees. Employees would retain the right to file an appeal in state Supreme Court.
The recently passed state budget included constructive changes to expedite decision-making in the states process for disciplining and removing ineffective teachers who have already earned tenure, Terranova said on behalf of the NYSCOSS. The legislation will strengthen the ability of schools to remove teachers whose conduct has demonstrated they should not be working with children.
